Antaq to begin public hearing on the privatization of Itajaí on February 24

ANTAQ will hold, between February 24th and April 10th, a series of public hearings to obtain contributions aimed at improving the technical and legal procedures related to the bidding process for the privatization of the Port of Itajaí (SC).
The legal drafts and technical documents related to the public consultation will be available on Antaq’s website.
The bidding process will grant permission to the future concessionaire to act as a port administration (or port authority) and as a container operator, providing services directly to users.
Up to R$ 2.8 billion in investments will be redirected to infrastructure adaptations throughout the contract, which, primarily, has a term of 35 years but could be extended up to 70 years at the Ministry of Infrastructure’s discretion.
In addition to investments in new assets, the current lessee shall receive nearly R$ 44.4 million as compensation for unamortized/depreciated assets.
For the entire term, the estimated value of the concession agreement, which corresponds to the present value of tariff and non-tariff revenues, is R$7.8 billion. The grant amount must be at least R$ 603 million to be used in the auction.
The auction is open to Brazilian and foreign legal persons, including financial institutions, Equity Investment Funds, and supplementary pension entities. However, consortiums between shipping companies and their corresponding controllers and subsidiaries that operate in the Port of Itajaí and São Francisco do Sul will not be entitled to participate in the bidding process.
Payments to the Federal Government
From the 6th to the 30th year of the contract, the concessionaire will pay a fixed contribution of more than R$ 35.8 million in 25 annual installments totaling more than R$ 35.8 million.
In addition, the concessionaire will pay a variable contribution equal to the annual amount resulting from the concessionaire’s charge of R$ 52.57 per TEU for container handling.
Finally, ANTAQ requires the concessionaire to pay an annual inspection fee of R$ 734,421 for the contract duration.
Social Participation
Antaq will only consider contributions submitted to ANTAQ by 11:59 p.m. on April 10th, exclusively through and in the electronic form available at gov.br/antaq.
A public hearing will be held, in person or via telepresence, depending on current public health conditions, on a date, time, and location to be determined and communicated in due course, with the goal of promoting discussions and clarifying any doubts about the normative act.
