ANTT issues fines for violations of truck minimum freight rate table

The National Land Transport Agency (ANTT) recently established the fine that will be charged for violation of the minimum truck freight rate. It will be twice equivalent to twice the difference between the freight paid and the amount that should have been paid, with a minimum fine of R$550 and and maximum of R$10,500.

ANTT define multas para quem não cumprir preço mínimo do frete
SÃO PAULO – A Agência Nacional de Transportes Terrestres (ANTT) definiu os valores das multas que serão aplicadas a quem descumprir os preços mínimos da tabela dos fretes rodoviários. Os valores da punição vão variar para contratantes, transportadores e anunciantes, e podem chegar a R$ 10,5 mil. A resolução 5.833 foi publicada hoje no “Diário Oficial da União”.
Para quem contratar o serviço de transporte rodoviário de cargas abaixo do piso mínimo estabelecido pela ANTT, a multa será de duas vezes a diferença entre o valor pago e o piso devido, limitada ao mínimo de R$ 550 e ao máximo de R$ 10,5 mil.
Para o transportador que realizar o serviço por um valor inferior ao piso mínimo, a multa será de R$ 550. Já os responsáveis por anúncios de ofertas para contratação do transporte rodoviário de carga por um valor inferior ao piso mínimo pagarão multa de R$ 4,97 mil.
Finalmente, os contratantes, transportadores, responsáveis por anúncios ou outros agentes do mercado que impedirem, obstruírem ou, de qualquer forma, dificultarem o acesso às informações e aos documentos solicitados pela fiscalização pagarão multa de R$ 5 mil.
“A ANTT poderá utilizar-se do documento que caracteriza a operação de transporte, de documentos fiscais a ele relacionados e das informações utilizadas na geração do Código Identificador da Operação de Transporte para comprovação da infração prevista neste artigo”, diz a resolução.
A agência já vinha realizando fiscalizações para verificar se a tabela estava sendo cumprida, mas apenas notificando os envolvidos que estavam fora da lei. Com a resolução, as multas podem ser aplicadas a partir de hoje.

New penalty fees for truck freight add uncertainty to Brazilian grains market
Brazil’s road transport regulator, ANTT, set a penalty fee of up to Real 10,500 ($2,800) for each transport contract hired below a recently created minimum price scheme, adding more uncertainty to the local logistics system as the country prepares to export a large grains crop.
The decision was published Friday in the official gazette and is immediately applicable.
The penalty will be calculated based the difference between the actual price paid to the truck drivers or truck company and the minimum price recently established by the federal government.
The minimum price table has brought uncertainties to the market, especially among grains traders. Brazil is the world’s largest soybeans exporter and one of the leading corn exporters and relies mostly on trucks to have the products delivered to the ports.
The table was created by a presidential act in the aftermath of a truckers strike in May. The decision was strongly opposed by manufactures and exporters.
The matter was taken to the Supreme Court and a final decision is still pending.
Meanwhile, several companies were reportedly hiring road freight at market prices, disregarding the table but knowing it could eventually lead to penalties.
Sources in the grain industry told S&P Global Platts it is still unclear how much the decision to set a value for penalties could affect current business, but they said it certainly adds more uncertainty and increases potential liabilities for the companies.
“I believe soybean purchases in the producing areas will be impacted. These fines could be a game changer, but who knows? Only time will tell,” a grains trader said.
Brazil is planting the 2018-19 soybeans and corn crop, which will be harvested and transported in the first half of 2019. Total soybean exports in the new season are currently projected at 76 million mt and corn at 31 million mt, according to official government estimates.
