Brazil: Public Consultation Launched for Amendment of Concession Contracts in Public Ports

Brazil’s National Waterborne Transport Agency (ANTAQ) initiated Public Consultation 08/2024 on Monday (06), with the contribution period extending until June 19, 2024.
The consultation aims to gather input, feedback, and suggestions to enhance the regulatory proposal for amending ANTAQ Resolution No. 85 of 2022, which governs the extraordinary review of concession contracts in public ports.
Additionally, it seeks to refine the provision regulating the Supported Proposal mechanism outlined in ANTAQ Resolution No. 61 of 2021. This mechanism allows for certain aspects of concession contracts to be altered, such as planned investments, provided they are mutually agreed upon with the users.

The period for submitting written contributions extends until 11:59 pm on June 19, 2024, exclusively through the electronic form available on the ANTAQ website. Contributions sent through other means will not be accepted.
The attachment of digital images, such as maps, plans, and photos, will be permitted exclusively via email: [email protected], along with taxpayer identification, within the specified deadline. However, sending attachments via email does not exempt the requirement of submitting the contribution in writing through the electronic form.
In cases where interested parties lack the necessary resources to submit contributions via the electronic form, they may do so using the computers at the General Secretariat (SGE) of this Agency in Brasília/DF or at its Regional Units, the addresses of which are available on the ANTAQ website.
