Brazilian Bill Seeks to Protect Seafarers’ Vacation Rights

The Chamber of Deputies is currently reviewing Bill 1392/24, which aims to amend the Consolidation of Labor Laws (CLT) to prohibit companies from scheduling vacations for maritime workers during their designated time off. This legislative proposal seeks to address a significant issue affecting the seafaring workforce.

According to the proposed text, it would be considered a violation of the collective bargaining agreement or convention if a seafarer’s vacation period overlaps, either wholly or partially, with their allocated days off.

Congressman Jonas Donizette, the author of the bill, recalled the demanding nature of maritime work. “Seafarers typically have an intense work schedule. For instance, those who work 180 days at sea are entitled to 180 days on land, which includes both days off and vacation time,” Donizette explained.

The problem, according to Donizette, is that many companies currently schedule seafarers’ vacations during their mandated leave periods. “As a result, crew members do not actually get to enjoy the vacation time they have earned,” he added.

Next Steps

The bill will undergo further scrutiny by the Work, Constitution and Justice, and Citizenship committees.
