Fines issued in São Paulo-based ports decrease year-on-year

The number of fines issued at the ports of Santos and São Sebastião and waterborne routes in São Paulo decreased by 14.9% in 2023 compared to the previous year. Last year, 40 citations were issued, down from 47 in 2022. These figures come from the National Waterway Transportation Agency (Antaq), the organization responsible for enforcement actions.

According to Antaq, 273 assessments were conducted at the two port complexes and waterways in São Paulo in 2023. Of these, 31 irregularities were reported, 16 cases of recurrence were identified, and 40 infractions were issued.

Overall, there was a reduction compared to 2022 when there were 312 inspections, 60 irregularity notifications, 47 fines imposed, and approximately 25 cases of recurrence.

In regards to the Port of Santos, the regulatory agency stated that inspections, conducted in collaboration with the National Land Transportation Agency (ANTT), focused on the new management and operations of the Internal Railway of the Port of Santos (Fips).

The new contract holder, AG-Fips, took over the onerous railway concession on October 1 last year.

According to Antaq, two joint inspections were conducted last year with Fips, in October and December.

The state agency noted that the inspections were implemented to monitor the investments and obligations outlined by Fips in the concession contract signed last year. The inspections examined both the railway and the operations that connect it to other transport models. However, Antaq did not disclose the results of these assessments.

In 2024, the agency plans to conduct diagnostic inspections at the ports of Santos, Suape, Manaus, and Rio Grande to assess the situation of these public assets. “Bottlenecks will be identified, and the economic-financial health of these ports will be evaluated,” the agency said.

Dredging contracts for some ports, including Santos, will also be assessed. Antaq will review the contracts, including surveys on existing bottlenecks, how each port administration prepares to address challenges related to this service, and the status of existing dredging contracts.

“We expect this effort to bring many results that will improve services that are fundamental for the survival, efficiency, and high-level operation of Brazilian ports,” emphasized Antaq’s director-general, Eduardo Nery.

Overall Figures

In 2023, Antaq conducted 4,431 inspections nationwide, 2.4% fewer than the previous year (4,541), and 45.9% more than in 2018.

The overall data was released during the presentation of the 2023 Waterborne Performance by Antaq earlier this month.
