Minister revokes decree that prevented outsourcing guard services at Port of Santos

Brazil’s Minister of Ports and Airports, Silvio Costa Filho, has revoked the decree that prohibited outsourcing security and surveillance services at federation-owned dock companies. The measure had been issued last month by the then-minister of the department, Márcio França. The reason he cited was the impact on the budget of port authorities. The revocation concerns the union representing port guards associated with the Port Authority of Santos (APS).

In a statement on its official website, the ministry explains the revocation was a suggestion by “the Ministry of Management and Innovation in Public Services (MGI) and coherent with formal flaws identified by legal consulting in the process.”

Decree 408, dated September 6, stipulated that port authorities could not outsource security and surveillance services until December 31, 2024, ensuring that only port guards from their own staff could perform these activities.

In a letter to the Ministry of Ports and Airports, the Secretariat for Coordination and Governance of State-Owned Enterprises, part of the Ministry of Management and Innovation, argues that the inability to hire outsourced personnel for this purpose could impact “budget forecasts, benefit plans, and supplementary pension plans for employees, among other aspects related to the management of federal state-owned companies.”

According to the Ministry of Management and Innovation, the measure “directly impacts six federal state-owned companies: Companhia Docas do Ceará (CDC), Companhia Docas do Pará (CDP), Companhia Docas do Rio de Janeiro (CDRJ), Companhia Docas da Bahia (Codeba), Companhia Docas do Rio Grande do Norte (Codern), and Autoridade Portuária de Santos (APS).”

The Ministry of Ports concludes by stating it “will create a permanent forum for discussion with port workers to address the issue with the necessary depth and legal security, listening to the demands and finding the most appropriate solution.”

The social director of the Union of Employees in Port Administration (Sindaport), Edilson de Paula Machado, said he learned of the revocation of the ordinance in a meeting last week at Silvio Costa Filho’s office, which he attended. “In a meeting with the minister on the 26th of last month, attended by representatives of the National Federation of Port Workers (FNP) and unions from all over Brazil, he committed to drafting a new ordinance with our participation.”

However, Machado expressed concerns about the lack of guarantees for the Port Guard’s role. “Outsourcing is bad. We believe that the Port Guard, linked to the Port Authority, represents the State, the Union, in port security. We want to prohibit outsourcing in the future. Leave it as it is in ports where this is already a reality. Only in Santos do we not have third parties working for the dock company,” he stated.
