Public Prosecutor’s Office investigates excessive delays at Port of Manaus

The Public Prosecutor’s Office of the State of Amazonas (MPAM) has launched a civil inquiry into complaints of excessive delays in loading cargo vehicles and passengers at the Port of Manaus.
The investigation, led by Justice Prosecutor Sheyla Andrade dos Santos, aims to ensure the enforcement of consumer rights, particularly regarding prompt service and the organization of port operations.
MPAM is responding to complaints indicating delays of over eight hours in loading/unloading cargo vehicles and delivering goods, causing significant disruptions to transporters and passengers using the Manaus Roadway Port.
In light of these complaints, MPAM has decided to open a civil inquiry to investigate potential violations of Law No. 5,857/22, which regulates consumer service time, as well as to examine possible irregularities in service delivery.
Prosecutor Sheyla Andrade dos Santos emphasized that all complaints will be thoroughly investigated. “We will certainly take all necessary measures to address any non-compliance, whether through a term of adjustment of conduct (TAC) or, if that is not feasible, a public civil action (ACP), to ensure the protection of consumers’ time. It is unacceptable to take eight hours to complete transportation or for a vehicle to board a vessel, whether for cargo or passengers. Therefore, these measures aim to produce more productive and satisfactory outcomes for the public and all port-related activities,” the prosecutor detailed.
The investigation involves Estação Hidroviária do Amazonas S/A and the Empresa de Revitalização do Porto de Manaus S/A, which manage the port terminal. The inquiry includes collaboration with agencies such as the Consumer Protection Institute of Amazonas (Procon/AM) and the Regulatory Agency of Delegated and Contracted Public Services of the State of Amazonas (Arsepam), which have been notified to assist in the investigation and conduct inspections on-site.
Among the inquiry’s requirements, Procon/AM must inspect the Manaus Roadway Port and verify compliance with current regulations, submitting a report to MPAM within 20 business days. Arsepam is also required to report any complaints received related to the port within 20 business days.
MPAM emphasizes that protecting consumer rights is a priority, and appropriate measures will be taken to ensure improved services at the Port of Manaus. The investigation seeks to guarantee the quality and efficiency of service and safeguard consumer safety and economic interests under the Consumer Protection Code.
