Pulp and vegetable oil associations to join Porto of Santos against Marimex

IBÁ (the Brazilian tree industry) which brings together the pulp paper companies, has asked Minister Jorge Oliveira, of the Federal Court of Accounts (TCU), to enter as amicus curiae (interested third party) in the process that extended the contract of Marimex in a strategic backport container area (without direct access to the pier) of the Port of Santos.
In addition to IBÁ, the Brazilian Association of Vegetable Oil Industries (ABIOVE) sided with the port authority of the Port of Santos (SPA) in the discussion.
According to SPA, there will be a loss of R$ 820.5 million from TCU’s decision that determines the granting authority to extend the company’s contract until the end of the agreement with the current railway operator, PORTOFER, in 2025.
The values of waivers to Port of Santos reach up to R$5.9 billion if Marimex manages to reach its final objective: to extend the extension for another 15 years, reaching the 20 years it claims to have the right to.
The revenue losses predicted by the port authority would occur for four main reasons:
Loss of direct revenue from leasing the Marimex area;
Loss of revenue (tariffs and variable lease) with reduced volume handled due to lack of railway capacity;
Rebalancing of Right Bank contracts (Elev, Portuárias, Copersucar, Hidrovias do Brasil, Suzano, Eldorado, Bracell, TXXXIC, TES and ADM); and
Loss of revenue with the postponement and phasing of bidding for the fertilizer terminal.
In view of this scenario, SPA filed an appeal in June this year in which it proposes the signing of a transitional contract with Marimex.
If the proposal is accepted, the Ministry of Infrastructure and SPA intend to bid on the site for a fertilizer terminal and a train maneuvering area (railway loop) to unlock a logistical problem at the port. Associations defend the same point of view.
