
São Paulo regional labor court makes contracting in port more flexible

The Regional Labor Court (TRT) of São Paulo issued an important decision for companies operating in ports. It defined that they do not need to hire workers exclusively through the labor-management agency (OGMO). According to the judges, if operators disclose vacancies to those registered with the entity and find no suitable candidates, they are free to then recruit employees in the market.
In this month’s decision, the 11th Panel overturned an appeal in a public civil suit in which SINDOGEESP (the crane and forklift operators union was asking for R$3.9 million in moral damages. The reason: the hiring, by R.D Locação e Serviços, of workers outside the OGMO system.
“The lack of interest of port workers registered with OGMO is a circumstance that has the power to make it possible to hire workers outside the system”, said the rapporteur of the case, the Honorable Flavio Villani Macedo (case No. 1001161-11.2019.5.02. 0445), in a note.
