Tax auditors announce another week of strike at Port of Santos

Amidst ongoing disagreements over productivity-based compensation, the deadlock between tax auditors and the Ministry of Finance persists for another week. The auditors have once again halted cargo clearance and public service at the Port of Santos Customs from Wednesday (7) until Saturday (10) while reviewing the ministry’s latest proposal. Notably, perishable, live, hazardous, medicinal, and onboard food items will be processed as usual. Sindifisco, representing the professionals, estimates a 40% delay in cargo clearance during the first two weeks of the strike.
Elias Carneiro, president of the local union branch, stated that the ministry’s proposal will be deliberated in a national assembly, which commenced on Tuesday and concludes on Thursday. “If the proposal is accepted, the mobilization will be suspended. If not, we will continue with the protest,” he affirmed.
Productivity-based compensation was established through Federal Law 13,464/2017, allocating 25% of the Special Fund for the Development and Improvement of Fiscal Inspection Activities (Fundaf) as a bonus to tax auditors and tax analysts at the Federal Revenue Customs. This percentage resulted from an agreement between the Ministry of Finance and the unions in 2016.
Carneiro reported that Finance Minister Fernando Haddad met with representatives of the National Sindifisco Union and the National Union of Tax Analysts of the Federal Revenue of Brazil (Sindireceita) on January 31 and February 1, proposing a phased and progressive bonus plan of up to 25%, payable from 2024 to 2027.
“The minister proposed the following percentages: from January to July 2024, up to 10.15%, with a limit of R$ 4,500 per month; from August 2024 to January 2025: 11.33%, with a limit of R$ 5,000/month; from February 2025 to January 2026: 15.25%, R$ 7,000/month; and from February 2026 to January 2027: 25%, R$ 11,000/month,” Carneiro outlined.
He clarified that these figures represent ceilings rather than the total amount paid in each stage. “A management committee calculates the basis and revenue, setting these limits. Therefore, the actual payment may be lower.” The Ministry of Finance declined to comment when contacted.
Repercussions
According to Carneiro, around 1,300 import declarations and 800 export declarations are delayed daily. Additionally, tax auditors continue to refrain from attending sessions or submitting any work except for judicial demands or those about to expire. “We estimate a further 40% delay in cargo clearance.”
