Reporto tax renewed until 2028 by Brazilian Congress

The Chamber of Deputies has approved Senate Bill 5610/23, extending until 2028 the validity of the Tax Regime for the Modernization and Expansion of Port Structures (Reporto), which expires at the end of this year. The proposal now awaits presidential approval.

Established by Law 11.033/04, Reporto provides tax incentives for investments in ports, such as the purchase of machinery and equipment with no domestic equivalents. Congress has extended these benefits since 2007, with recent expansions to railway concessionaires.

The special regime allows beneficiaries to acquire equipment with exemptions from IPI, PIS, Cofins, and Import Tax (II).

In the Chamber, the bill’s rapporteur, Representative Hugo Motta (Republicans-PB), emphasized the significance of the proposal for the port sector.

The Brazilian Association of Port Terminals (ABTP) estimates that over R$ 50 billion will be invested in the sector due to the extension of Reporto.

Anderson Pomini, President of the Port Authority of Santos, commended the political class for maintaining Reporto: “Everyone benefits when Brazil comes first. Reporto generates wealth and jobs for the country.”

Fenop celebrates

The extension of Reporto until 2028 is a victory for the port and railway sectors, stated a release from the National Federation of Port Operations (Fenop). “Reporto ensures more investments, stimulating sector growth with job creation and technological modernization, positively impacting the economy.”

The statement, signed by various entities, expressed gratitude for the sensitivity of the Ministry of Ports and Airports (MPor) and highlighted the support of Minister Sílvio Costa Filho in advancing the proposal in the National Congress and its necessary extension.

“We are confident that Bill 5610/2023 will be sanctioned by the President of the Republic, allowing the extension of the Regime from 2024,” concludes the document signed by the Brazilian Association of Container Terminals – ABRATEC; Brazilian Association of Liquid Terminals – ABTL; Brazilian Association of Port Terminals – ABTP; Brazilian Association of Terminals and Customs Warehouses – ABTRA; Association of Private Port Terminals – ATP; National Federation of Port Operations – FENOP; Brazilian Railway Industry Association – ABIFER; and National Association of Railway Transporters – ANTF.
