Government Launches Public Consultation on Long-Term Maritime Transport Contracts

The Ministry of Ports and Airports (MPor) opened a public consultation on Thursday (17) to discuss the draft that defines the essential clauses of long-term transport contracts to be signed between shipping companies and cargo shippers. The deadline for submitting contributions is July 31, 15 days from now, via the Participa + Brasil platform.
The proposal under review complies with Article 7 of Law No. 14,301/2022, which established the BR do Mar Program — an initiative aimed at expanding cabotage shipping in Brazil. The objective is to develop clear and secure guidelines for long-term contracts, taking into account both the technical and legal aspects of international and domestic maritime transport.
Key elements of the draft include risk allocation between parties, a minimum contract term of five years, and provisions for penalties in the event of early termination. The proposal also draws on established international practices to ensure a balanced distribution of rights and responsibilities between shippers and carriers.
According to the National Secretary for Waterways and Navigation, Dino Antunes, the measure represents progress not only in legal certainty for operations but also in promoting sustainability. “The contract includes mechanisms that encourage decarbonization and the adoption of more sustainable practices in maritime transport. It also fosters competition and improved quality in Brazil’s cabotage services,” he said.
The public consultation is a vital step in the regulatory process, reinforcing the Federal Government’s commitment to a participatory, transparent governance model aligned with sustainable development principles.
