Brazil’s Federal Court of Accounts (TCU) decided on Wednesday (21) to waive prior review of the public offering model proposed by Infra S.A. to grant paid use of 12 sites for the development of logistics terminals along the North-South Railway (FNS).

The agreements granting paid use of the sites may be finalized without prior clearance from the TCU. However, the court’s plenary ordered that implementation of the model be monitored through a separate proceeding, without precluding subsequent audits if risks or signs of irregularities are identified.

The railway’s 12 sites are spread across municipalities in Tocantins, Goiás and São Paulo and cover approximately 765.5 hectares. All are classified as land intended for new logistics facilities, with no operational infrastructure ready for immediate use.

Infra S.A. designed the model to provide greater flexibility in making land, rail yards and logistics facilities under its administration available for use. The process provides for companies to express interest, an assessment of whether proposals meet eligibility requirements, preparation of a Simplified Feasibility Study (EVS), and the opening of a competitive window during which third parties may also submit projects.

If competing applicants submit proposals that cannot be accommodated together, a simplified competitive process will be held, with objective selection criteria.

Payments to the state-owned company will include a fixed component, calculated based on the Site Reference Value (VRA), and a variable component tied to actual cargo throughput, using an adjustment factor applied to the reference tariff set by Brazil’s National Land Transport Agency (ANTT).
