Anatel redefines import procedure for telecommunications equipment

Anatel published, on the evening of November 25, Administrative Order No. 18,086, establishing a new operational procedure for the import of telecommunications products subject to the agency’s certification. The measure enables the authority to obtain direct access to data from the Integrated Foreign Trade System (SISCOMEX), particularly the information declared in the Single Import Declaration (DUIMP).
With the new system, Anatel will monitor in real time the flow of imported telecommunications equipment, cross-checking data such as manufacturer, model, and serial number with its database of certified products.
The objective is to reinforce the fight against the entry of uncertified equipment and prevent risks to network and user security, explained Vinicius Caram, Superintendent of Licensing and Provision Resources, during a certification forum held in Campinas (SP), broadcast online. He also said that a public consultation to revise the rules on the use of the Anatel label on certified equipment will open on the 27th.
New import procedure
The annex to the order defines three types of operations that will be subject to verification: imports for own use, for use in own or operated networks, and for commercialization. This includes manufacturers and operators as well as regional providers, system integrators, and companies that use terminals and optical, radio or IoT equipment.
The agency will begin handling these operations administratively based on DUIMP information. In other words, it will be able to adopt compliance measures (including confiscation of equipment) while the customs clearance process is still underway. The procedure also includes risk analysis to guide more effective inspection actions.
Legal basis and replacement of the previous order
The text cites provisions of the General Telecommunications Law that prohibit the use and connection of equipment without certification issued or accepted by Anatel. It also reinforces that certification is mandatory for using and commercializing telecommunications products in Brazil.
With the publication, Administrative Order No. 4,521 of 2021, which governed the agency’s role in import processes, is revoked.
Measure takes effect in 2026
Anatel reported that it will begin discussions with the Secretariat of Foreign Trade (SECEX) to operationalize access to the relevant DUIMP fields. Guidance to the industry on correct declaration procedures is also expected, as well as internal training of staff who will work with the data.
The new procedure will take effect on May 25, 2026 — the time required for system adaptation and coordination among the agencies involved.
