ANTAQ launches consultation on time charter rules for Brazil’s cabotage shipping

The National Waterway Transport Agency (ANTAQ) opened, this Tuesday (23), the process of receiving contributions on time chartering in maritime navigation, with emphasis on cabotage.

The objective is to obtain input, subsidies, and suggestions regarding the preliminary Regulatory Impact Analysis (RIA) report on this topic, which is included in the 2025/2028 Regulatory Agenda. Contributions can be submitted until October 23, 2025.

The report proposed several solutions, focusing on the transport segment of solid bulk and neo-bulk cargoes, including linking chartering to a specific cargo, expanding requirements, regulating partial blocking, establishing a maximum period for time chartering, and extending the duration and advance notice of circularization in relation to shipments.

Social participation will allow the improvement of the foundations that will support the enhancement of regulatory instruments related to time chartering in cabotage navigation. Additionally, the update is necessary to ensure that chartering procedures are aligned with the improvements introduced by Law 14.301/2022, of March.

A live webinar will also be held to present the technical aspects of the RIA report. The date will be announced soon. The event will be broadcast on ANTAQ’s YouTube channel.

The Public Consultation SRG No. 2/2025-ANTAQ is exclusively focused on cabotage navigation. It is part of Topic 2.1 of ANTAQ’s 2025/2028 Regulatory Agenda — Time Chartering in Maritime Navigation, which also includes offshore support navigation. However, for this latter segment, a specific RIA report is being prepared and will soon be submitted for public review and comment.

Contributions may be submitted to ANTAQ until 11:59 p.m. on October 23, 2025. Submissions must be made exclusively via the electronic form available on the agency’s website. For sending digital images, such as maps, blueprints, and photos, please send them to the email address: srg@antaq.gov.br.

If the interested party does not have the necessary resources to send the contribution through the electronic form, it may be submitted using a computer at the General Secretariat – SGE, in Brasília, or at ANTAQ’s Regional Units, whose addresses are available on the agency’s website.
