ANTAQ launches new study to improve private terminal regulation

With a focus on improving regulation of the port sector and ensuring greater efficiency in the implementation process of private terminals, the National Waterway Transportation Agency (ANTAQ) has completed the study “Diagnostic on the Implementation of Private Use Terminals (TUPs).”

Approved in a board meeting last Thursday (6), the unprecedented report is part of the 2021/2024 Multi-Year Study Agenda. The full diagnostic document will be published on the Agency’s website soon.

The study analyzed the outlook of TUPs with authorizations granted between 2013 and 2019, offering a detailed view of the development of these projects and identifying the main factors that contribute to the failure to begin operations within the five-year period established by Decree No. 8,033/2013. The survey will serve as a basis for improving rules and procedures and increasing predictability in the sector.

Between 2013 and 2019, ANTAQ granted 70 authorizations for private terminals nationwide. The study shows that more than 53 of these projects are already operational, representing 75.71%.

Of the 17 terminals still not operational (24.29%), companies citing environmental, financial, and legal issues accounted for 55.17% of the reasons for not meeting the legal deadline. According to the analysis, 11 of the 17 terminals under implementation have already received deadline extensions, and another 3 are under review, demonstrating ANTAQ’s ongoing monitoring and willingness to promote solutions that reconcile legal certainty, sustainability, and efficiency.

For cases that have not yet started operations, the diagnostic provides technical input to improve the regulatory environment, highlighting the mapping of environmental, financial, and legal aspects that affect project progress.

The initiative reinforces ANTAQ’s commitment to producing technical and regulatory knowledge grounded in evidence, which guides strategic decisions and strengthens Brazil’s port infrastructure.
