Antaq upholds Santos Port Authority tender for logistics complex on Santos right bank

Brazil’s port regulator Antaq has rejected a request by container terminal association Abratec to annul Tender Procedure No. 01/2025, which covers the development of a logistics complex in the Saboó area of Santos.
The decision was made unanimously by Antaq’s collegiate board during a regular meeting on Thursday, August 13. Under Ruling No. 476/2026, the agency validated the tender notice issued by the Santos Port Authority, or APS, and preserved the steps already taken in the bidding process, rejecting any declaration that the tender was null and void.
Antaq Director Alber Vasconcelos, the case rapporteur, said in his vote that port planning should not be treated as a static instrument. He also said the APS tender notice was transparent, with no “lack of clarity regarding the asset offered to the market” and no impairment to publicity, equal treatment among interested parties or competitiveness.
During oral arguments at the meeting, APS’ defense said the contract creates support infrastructure that will allow the port to grow more efficiently without pushing the effects of rising cargo volumes onto the city in a disorderly way.
According to APS, the tender is based on planning designed to address a long-standing bottleneck: the lack of support areas and the irregular parking of trucks on public roads. The port authority also pointed to the need for an integrated public solution to meet growing demand.
The planned logistics complex in Saboó will cover 242,000 square meters and is intended to create a truck staging yard with initial capacity for 400 vehicles. The goal is to organize heavy-vehicle traffic, reduce congestion and provide rest areas and services for truck drivers.
